1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and Trev ("Company," "we," "us," or "our") concerning your access to and use of the Trev AI-refined translation platform and all related services.

By creating an account, accessing, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.

2. Service Description

Trev is an AI-refined translation platform that provides professional-quality translations through a multi-stage process combining machine translation with AI refinement. Our services include:

• Document translation with format preservation (XLIFF, DOCX, SRT, CSV, TXT, and more)
• Audio and video file transcription and translation
• Smart Translator system for efficient processing of files
• Language-specific optimization for natural-sounding translations
• Translation history and retrieval (7-day storage)
• API access for integration (on select plans)

Service Limitations

Our services are designed for general business and personal use. We do not provide:

• Certified or notarized translations for legal proceedings
• Medical translations for diagnostic or treatment purposes
• Real-time interpretation services
• Human translator review (unless specifically offered)

3. User Accounts

3.1 Account Registration

To use our services, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Maintain the confidentiality of your account credentials
• Immediately notify us of any unauthorized access or security breach
• Accept full responsibility for all activities under your account

3.2 Account Sharing Prohibited

Each account is strictly for individual use only. Account sharing is prohibited and will result in immediate termination. You agree not to:

• Share your login credentials with any other person or entity
• Allow others to access our services through your account
• Create multiple accounts to circumvent usage limits
• Transfer, sell, or assign your account to another party

3.3 Business Accounts

If you require multiple users for your organization, each user must have their own individual account. We may offer enterprise solutions with centralized billing in the future.

4. Credits, Billing & Payment Terms

4.1 Credit System

Our services operate on a credit-based system:

• Credits are consumed based on text volume translated
• See our Help Center for detailed credit usage information
• Audio/video transcription is measured in minutes
• Credits are deducted based on source content length, not output

4.2 Subscription Plans

We offer various monthly subscription plans:

• Monthly Credits: Included with your plan, do NOT roll over
• Automatic Renewal: Plans renew monthly unless cancelled
• Plan Changes: Upgrade anytime, downgrades effective next billing cycle
• Cancellation: Cancel anytime, access continues until period ends

4.3 Top-up Credits

• Additional credits can be purchased anytime
• Top-up credits never expire while account is active
• Top-up credits are used after monthly credits are exhausted
• Non-refundable once purchased

4.4 Payment Processing

• All payments are processed securely through Stripe, Inc.
• We do NOT store credit card information on our servers
• Payment data is handled according to PCI DSS standards

4.5 Billing Policies

• All fees are in USD unless otherwise specified
• Prices exclude applicable taxes (VAT, GST, etc.)
• Failed payments may result in service suspension
• We reserve the right to change prices with 30 days notice

4.6 Refund Policy

• No refunds for used or unused monthly credits
• Top-up credits are non-refundable once purchased
• Refunds may be considered for technical failures on our part
• Billing errors must be reported within 30 days

4.7 Accuracy Challenge

Our one-time Accuracy Challenge is designed for testing our service quality. Credits from this package do not expire but cannot be combined with subscription plans.

5. AI Translation Services

5.1 Translation Process

Our AI-refined translation process uses multiple technologies to deliver high-quality results:

• Initial machine translation using industry-leading engines
• AI refinement for natural language expression
• Language-specific optimization
• Format preservation and reconstruction

5.2 Translation Accuracy

While our AI refinement process significantly improves translation quality, you acknowledge that:

• No automated translation is 100% accurate
• Results may require human review for critical applications
• Specialized terminology may need domain-specific adjustment
• Cultural nuances may require human interpretation

5.3 Processing Times

Translation times are estimates and may vary based on:

• File size and complexity
• Selected language pairs
• Current system load
• Use of Smart Translator system for larger files

5.4 Supported Languages

We support 90+ language pairs with varying levels of refinement. Premium languages undergo additional optimization for more natural-sounding results. Language availability may change as we improve our services.

5.5 AI Translation Notice - Natural Variation

Our platform uses advanced artificial intelligence that produces naturally varied translations. By using our service, you acknowledge and accept that:

• Translation Variability: Each translation is uniquely generated. The same source document will produce different (but contextually accurate) translations each time it is processed. This is intentional and reflects natural language diversity, similar to having different professional translators work on your content.
• Adaptive Processing: Our AI system automatically detects document type and intended audience, adapting the translation style accordingly (formal for business documents, accessible for educational materials, etc.).
• No Update Pricing: As each translation is freshly generated using the most current AI technology, document updates require full retranslation at standard rates. We do not offer reduced pricing for modifications to previously translated documents.
• Quality Through Variation: While translations of the same content will vary, all maintain professional quality and accuracy. Natural variation between translations is a feature that ensures dynamic, contextually appropriate output rather than rigid, mechanical translations.
• Technology Evolution: Each translation benefits from our latest AI improvements, meaning quality continuously improves over time.

5.6 Service Availability

• Target 99% uptime (excluding scheduled maintenance)
• Scheduled maintenance: Sundays 2-4 AM AEST
• No guaranteed turnaround times
• Smart Translator processing: typically 2-10 minutes depending on file size

6. Service Limits

To ensure quality and system stability, the following limits apply to all translations:

• Maximum 5 files per translation batch
• Maximum 5 target languages per translation
• Individual file size limit: 50MB
• Maximum 150,000 characters (150 credits) per file
• Transcription limit: 25 minutes per media file

Files exceeding these limits may be rejected or processed through our Smart Translator system. Large files are automatically processed in the background, and you will receive an email notification when your translation is complete.

7. Acceptable Use Policy

7.1 Permitted Use

You may use our services for legitimate business and personal translation needs, including:

• Business communications and documentation
• Educational materials and research
• Creative content and media
• Personal correspondence
• Website and application localization

7.2 Prohibited Content

You may NOT use our services to translate or process:

• Content that violates any applicable laws or regulations
• Hate speech, harassment, or discriminatory content
• Sexually explicit content involving minors
• Content that infringes on intellectual property rights
• Malicious code, viruses, or harmful software
• Spam, phishing, or fraudulent content
• Content that violates privacy rights or contains unauthorized personal data
• Disinformation or content intended to mislead

7.3 Prohibited Activities

You agree not to:

• Attempt to reverse engineer our AI refinement process
• Use automated systems to abuse or overload our services
• Resell our services without authorization
• Circumvent usage limits through any means
• Use our services to create a competing translation platform
• Scrape, harvest, or collect data from our platform
• Interfere with other users' access to our services

7.4 Enforcement

Violations may result in immediate suspension or termination without refund. We reserve the right to review content and refuse service at our discretion.

8. Intellectual Property Rights

8.1 Your Content

You retain all rights to content you submit for translation ("Your Content"). By using our services, you grant us a limited, non-exclusive license to:

• Process Your Content through our translation systems
• Store translations for 7 days for retrieval purposes
• Display Your Content back to you through our interface
• Create temporary backups for service continuity

This license automatically terminates when Your Content is deleted from our systems.

8.2 Your Representations

You represent and warrant that:

• You own or have rights to all content you submit
• Your Content doesn't infringe on third-party rights
• You have necessary permissions for any personal data in Your Content
• Your use complies with all applicable laws

8.3 Our Intellectual Property

The Trev platform, including all software, algorithms, interfaces, and documentation, is our proprietary property protected by intellectual property laws. You may not:

• Copy, modify, or create derivative works
• Reverse engineer or attempt to extract source code
• Remove or alter proprietary notices
• Use our trademarks without permission

8.4 Feedback

Any feedback, suggestions, or ideas you provide become our property and may be used without compensation or acknowledgment.

9. Data Privacy & Security

9.1 Data Processing

We process Your Content solely to provide translation services. We do not:

• Use Your Content to train our AI models
• Share Your Content with third parties (except subprocessors)
• Access Your Content except for support or legal requirements
• Retain Your Content beyond stated retention periods

9.2 Data Security

We implement industry-standard security measures including:

• Encryption in transit and at rest
• Access controls and authentication
• Regular security audits
• Secure data centers

9.3 Data Retention & Deletion

• Translations: Automatically deleted after 7 days
• Account data: Retained while account is active
• After 7 days: All translation files are permanently removed
• Account deletion: All data removed within 30 days of request
• Legal holds: Data may be retained as required by law

9.4 GDPR Compliance

For users in the European Economic Area, we comply with GDPR requirements. See our Privacy Policy for details on data subject rights and processing bases.

9.5 Confidentiality

We understand the sensitive nature of translation work and maintain strict confidentiality. Our employees and contractors are bound by confidentiality agreements.

10. API Terms (If Applicable)

10.1 API Access

If your plan includes API access, these additional terms apply:

• API keys are confidential and must be secured
• Rate limits must be respected
• API access is non-transferable
• We may modify API specifications with notice

10.2 API Restrictions

You may not use our API to:

• Create a service that primarily offers translation without substantial additional value
• Exceed rate limits or attempt to circumvent them
• Share API keys or allow unauthorized access
• Use the API in ways that could harm our infrastructure

11. Warranties & Disclaimers

11.1 Service Availability

We strive for high availability but do not guarantee uninterrupted service. Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF TRANSLATIONS

12. Limitation of Liability

12.1 Limitation on Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TREV BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
• LOSS OF DATA OR USE
• COSTS OF SUBSTITUTE SERVICES
• DAMAGES ARISING FROM TRANSLATION ERRORS

12.2 Cap on Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12.3 Exceptions

Some jurisdictions do not allow limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Trev, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of our services
• Your Content or translations thereof
• Your violation of any third-party rights
• Any misrepresentation by you

14. Termination

14.1 Termination by You

You may cancel your subscription anytime through your account settings. Cancellation takes effect at the end of the current billing period.

14.2 Termination by Us

We may suspend or terminate your account immediately for:

• Violation of these Terms
• Non-payment or payment disputes
• Suspected fraudulent activity
• Account sharing or security violations
• Legal requirements or court orders

14.3 Effect of Termination

• Access to services ceases immediately
• No refunds for unused credits or partial periods
• Your Content may be deleted after 30 days
• Certain provisions of these Terms survive termination

15. General Terms

15.1 Governing Law

These Terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes shall be resolved through binding arbitration in Queensland, Australia under the rules of ACICA (Australian Centre for International Commercial Arbitration). Class actions are waived.

15.3 Changes to Terms

We may update these Terms. Material changes will be notified 30 days in advance. Continued use after changes constitutes acceptance.

15.4 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Trev.

15.5 Severability

If any provision is found unenforceable, the remaining provisions continue in full effect.

15.6 Assignment

You may not assign these Terms. We may assign our rights to any successor or acquirer.

15.7 Force Majeure

Neither party is liable for delays due to circumstances beyond reasonable control.
